TACKL PRIVACY POLICY BY USING OR ACCESSING THE TACKL PLATFORM, OR BY ACCEPTING THE TACKL TERMS AND CONDITIONS, YOU ACKNOWLEDGE THAT YOU HAVE THOROUGHLY REVIEWED AND UNDERSTAND THIS TACKL PRIVACY POLICY AND HEREBY EXPRESSLY AGREE TO BE BOUND BY IT. IF YOU DO NOT AGREE TO THIS TACKL PRIVACY POLICY, YOU SHALL NOT ACCESS OR USE THE TACKL PLATFORM, REGISTER FOR A TACKL ACCOUNT, OR UTILIZE ANY OF TACKL’S SERVICES. Tackl SLX, LLC (“Tackl”) has established this Tackl Privacy Policy (collectively, the “Privacy Policy”), as amended from time to time, to govern how Tackl collects, processes, and/or uses information that Tackl requests, receives, and/or otherwise collects via the Platform. The term “You” or “Your” refers to visitors, Users, Professionals, and any other users of any part of the Platform. Tackl is hereby providing this Privacy Policy to inform You: (a) how Tackl collects, processes, uses, shares, and secures the Personal Information You provide and (b) to describe Your choices regarding use, access, and correction of Your Personal Information.   1. Definitions. When used in this Privacy Policy, the capitalized terms listed below shall have the following meanings: “Ad Partner(s)” has the meaning as set forth in Section 2.4(b). “Cookies” has the meaning as set forth in Section 2.4(b). “Content” means any information, data, materials, or submissions posted, uploaded, shared, transmitted, or made accessible by a Person on the Platform, including but not limited to text, images, videos, audio recordings, graphics, comments, messages, links, files, reviews, and any other form of digital or multimedia content. “Law” means any statute, law, ordinance, regulation, rule, code, order, constitution, treaty, common law, judgment, decree, other requirement, or rule of law of any federal, state, local or foreign government, or political subdivision thereof, or any arbitrator, court, or tribunal of competent jurisdiction. “Non-Personal Information” has the meaning as set forth in Section 3.5. “Person” means an individual, corporation, partnership, joint venture, limited liability company, governmental authority, unincorporated organization, trust, association, or other entity. “Personal Information” means and includes any information relating or pertaining to an identified or identifiable natural person. “Platform” means the websites, mobile applications, software, services, programs, networks, and platforms of any kind whether in existence now or hereinafter created or provided by Tackl, whereby Users may submit Orders, obtain Quotes, and upon such User’s election, seek to be connected to Professionals to provide certain repair or maintenance services for specific Projects. “Professional” means any Person that currently, or within the past six (6) months, offered repair or other services on the Platform. “Project” means a specific task, assignment, or job for which a User submits an Order on the Platform, which may encompass various repair or other services to be provided by one or more Professionals. “Tackl Account” means an account created by a User or Professional to access the Tackl Platform. “Terms and Conditions” means the Tackl Terms and Conditions, as may be amended from time to time. “User” shall mean a Person using the Platform for the purpose of receiving a Quote and/or to be potentially connected to one or more Professionals to provide repair or maintenance services required to complete a Project. “User Data” means any User’s information, data, content, or materials that is provided to a Professional by such User or Tackl in connection with the execution, evaluation, or completion of a Project, including but not limited to personal or contact information, documents, files, images, text, audio recordings, and any other form of digital or physical data.
  2. Information Tackl Collects. 2.1 General Purpose. To provide the Tackl products and services, and to otherwise operate the Platform, Tackl must process information about You. The type of information that Tackl collects depends on how You use and interact with the Platform, as set forth in this Privacy Policy. Because Tackl changes its offerings and features from time to time, the information collected or requested from You may also change. Depending on how You interact with the Platform, the Personal Information collected may vary. Because much of this information is necessary for Tackl to provide You with Tackl’s products and services, if You choose to not share this information, You may not be able to use some features on the Tackl Platform. 2.2 Information You Provide to Tackl. (a) Information Collection. Tackl collects information that You provide, including Tackl Account and profile information, Content submitted or posted on the Platform, and purchase and/or subscription information. (b) Tackl Account and Profile Information. When You create a Tackl Account on the Platform, Tackl collects Personal Information You provide, such as name, email address, interests, gender, age, and profile information. If You are a Professional, You may also provide Tackl business information, including but not limited to, business name, description, contact information, and geographic areas served. If You use financial tools or services offered through the Platform, Tackl may collect information necessary to facilitate those transactions, including but not limited to, copies of identification cards, proof of ownership, bank name, account numbers, credit card information, tax numbers, and other business documentation to verify Your identity or integrate with third-party service providers. (c) Content and Information You Submit. Tackl collects information, User Data, and Content that You submit, share, or create across the Platform. This includes information and Content submitted, shared, or created, including but not limited to Your company information, reviews, messages, comments, searches, discussion, Project details, Project costs, Project timelines, change orders, and invoices. (d) Communications. When You communicate with Tackl (via email, phone, through the Platform, or otherwise) and when You use the Platform to communicate with others, Tackl may record, monitor, collect, and use details about You and Your communications (including call time and call duration). To the extent You communicate with Professionals and other users outside the Platform, those communications are not subject to this Privacy Policy. (e) Consent. Tackl may also rely on Your consent to process Your Personal Information. If Tackl requires Your consent to collect and process certain Personal Information, Tackl will request Your consent at the time Tackl requests this Personal Information to be provided, and processing this Personal Information will only be performed if You give Your consent, unless Tackl has another lawful basis on which to rely. You may withdraw Your consent, as further detailed in this Privacy Policy. 2.3 Information from Third Parties. (a) Third Party Information Collection. Tackl collects information that others make available to Tackl, including information from other platforms, publicly available information, information from other users of the Platform, information from Tackl partners, service providers, and corporate affiliates, and information from third-party sites. When You submit Personal Information to any third party and are informed at the time of collection that Your information may be shared with Tackl, Tackl may collect that information for lawful marketing purposes. (b) Other Platforms. Tackl may receive information about You from third-party platforms when You allow the third-party platform to share this information with Tackl or allow Tackl to obtain this information from the third party. Tackl may also receive information about You when You upload Your contacts from Your third-party email service, use the Platform (or a third-party integration on the Platform) to manage Your calendar on another platform, or use the Platform to manage and send communications (e.g., email or text messages). (c) Public Information. If You are a Professional, Tackl may collect and verify information about You from publicly available sources and where permitted by applicable Law or, with Your permission, make it available as part of the Platform. For example, Tackl may receive Your name and contact information from industry associations and dealer networks in which You participate and display Your affiliation with these organizations. Tackl also may collect and display the details of any license You have using publicly available records. (d) Professionals and Users. If you are a User, in order to enhance the quality of the Platform, Professionals on the Platform may provide Tackl information about Your engagement with them, including whether You have contacted them or responded to them, the financial and service details of the engagement, and whether Your Project has been completed. (e) Tackl Partners and Service Providers. Tackl may receive information about You from Tackl partners and service providers. For example, Tackl payment processors may update Your payment information, Ad Partners (defined below) may help send communications to Your address, and third parties may help prevent fraud by verifying Your contact information. In addition, Tackl financial partners that conduct “know Your customer” or “know Your business” (KYC or KYB) verification and the banking partners may provide Tackl with information they collect directly from You. 2.4 Automated Data Tackl Collects. (a) Automated Information Collection. Each time You access the Platform, information is sent to the Tackl server by Your internet browser or app and stored in log files. Tackl collects information about Your use of the Platform, including Your search activity, the pages You view, the date and time of Your visit, and if You use browser extensions, the content You interact with on third-party sites, and how You navigate and interact with a page or screen. Tackl also collects information that Your device provides to Tackl in connection with Your use of the Platform, such as Your browser type, type of device, browser language, IP address, mobile carrier, unique device identifier, and requested and referring URLs. (b) Cookies. Technology known as cookies, web beacons, locally shared objects (sometimes called “flash cookies”), mobile identifiers and similar technologies (collectively referred to as “Cookies”) are collected, stored, and used by Tackl and its partners, which includes but is not limited to advertising, marketing, and analytics providers (collectively referred to as the “Ad Partners”). Tackl and its Ad Partners use Cookies to remember Your settings and for authentication and analytics. These technologies may be used to (among other things) analyze trends, administer the Platform, track Your interactions with the Platform, and to gather demographic information about Tackl’s collective User and Professional base. Tackl’s Ad Partners may also use Cookies to deliver advertisements to You. You are able to control the use of Cookies at the individual browser level, but if a You choose to disable Cookies, it may limit Your ability to use certain features or functions on the Platform and related products and services. (c) Log File Information. Log file information is automatically reported by Your browser or mobile application each time You access the Platform. For example, when You access any part of the Platform, Tackl servers will automatically record certain information that Your web browser sends when You visit the Platform. These server logs include information such as Your web request, internet protocol address, browser type, referring/exit pages and URLs, number of clicks, domain names, landing pages, and pages viewed. (d) Device Information. Tackl collects information about the device You are using to access the Platform, including but not limited to the type of device, operating system, settings, unique device identifiers, and internet protocol address. Whether Tackl collects some or all of this information often depends on what type of device You are using and its settings. Certain types of information are available depending on whether You are using a Mac, a PC, an iPhone, or an Android phone. Tackl collects the device type and any other information You choose to provide, such as username, geolocation, or email address. Tackl also may use mobile analytics software to allow Tackl to have a better understanding of and make necessary improvements to the functionality of its mobile software on phones. This software records information such as how often You use the Platform on phones, the events that occur within Your use of the Platform on phones, aggregated usage, performance data, and from where any Platform applications were downloaded. Tackl does not link the information it stores within the analytics software to any personally identifiable information You submit within the Platform, including (but not limited to) mobile applications.
  3. How Tackl Uses Information. 3.1 Information Use. Tackl uses the information it collects to provide products and services to You; to provide, support and personalize the Platform; and to communicate with You about the Platform. In order for Tackl to best provide these products and services (and assist in it being feasible to do so), it is essential that Tackl collects and uses the information as set forth in this Privacy Policy. The ways Tackl does this include (but are not limited to) the following: (a) To provide and improve the Platform and its features and functionality, including to process, store, and deliver Your communications; (b) To provide customer service and support; (c) To respond to Your inquiries or requests; (d) To back-up systems; (e) To improve the security of the Platform; (f) To evaluate use of the Platform for Tackl business purposes and to provide and improve Tackl services, including the Platform’s functionality; (g) To personalize Your experience, such as tailoring the content and information made available to You and Tackl support services; (h) To display relevant or targeted advertising (on the Platform and third-party sites) for Tackl and other businesses and to evaluate the success of such advertising; (i) To provide feedback to Professionals on the Platform, based on reviews or otherwise; (j) To communicate with You as described in Tackl agreements with You (for example, the Tackl Terms and Conditions) or this Privacy Policy; (k) To prevent fraud and to maintain a quality experience for Tackl business purposes or legal reasons, including to filter for spam and communications that violate Tackl agreements with You; (l) To enforce compliance with Tackl agreements with You (for example, the Tackl Terms and Conditions) and applicable Law; (m) To comply with legal obligations; (n) To prosecute or defend a lawsuit, arbitration, or similar legal proceeding; (o) To respond to lawful requests by public authorities (including national security or law enforcement requirements); and (p) To perform research and analysis for Tackl business purposes. 3.2 Communications. Tackl may use Your communications generally for quality assurance purposes and training, and to improve Tackl services. Tackl may use Your communications to understand and help manage the quality of requests received, and responses sent, by Professionals on the Platform and to provide them with feedback. Tackl may use automated technology to review Your communications and improve user experience. 3.3 Device and Activity Data. Tackl uses Your device information, internet protocol address, and other information Tackl collects from Cookies and similar technologies for personalization, advertising, and operating the Tackl Platform. Some of the information Tackl collects from using Cookies is essential to provide the Platform’s services to You, such as helping You log in to Your Tackl Account; other uses of this information assist Tackl with the performance and functionality of the Platform; and other uses of this information enable Tackl to analyze site usage and improve the Platform. Tackl also enables Tackl service providers, third-party businesses advertising on the Platform, advertising networks, and Ad Partners to use Cookies or similar technologies to track Your activities on the Platform and other online properties in order to provide You with tailored ads across websites, apps, and devices and to understand how those ads perform. 3.4 Purchases and Payment Information. For Your convenience, Tackl and its payment processors may store information about the payment method You use in connection with the Platform. 3.5 Non-Personal Information. When Tackl collects information that does not identify a specific natural person (“Non-Personal Information”), it may use and disclose this information for any purpose at all whatsoever, unless such use is otherwise prohibited by this Privacy Policy or applicable Law. Examples of Non-Personal Information include but are not limited to the following: physical location information; demographic information (gender, date of birth, ZIP codes, etc.); or any other Personal Information that has been anonymized, aggregated, or de-identified. If Tackl combines any Non-Personal Information with a Your Personal Information (such as combining Your ZIP code with Your name), Tackl will consider such combined information as Personal Information and will use and disclose such Personal Information in accordance with this Privacy Policy. Similarly, if applicable Law requires Tackl to treat certain Non-Personal Information as Personal Information, then Tackl will use and disclose this information as Personal Information in accordance with this Privacy Policy.
  4. How Tackl Shares Information. 4.1 General. Tackl works with third-party partners that help Tackl improve its products and services, which makes it possible for Tackl to operate its business and provide its products and services to You. Tackl does not sell Your Personal Information and imposes strict restrictions on how its Ad Partners, affiliates and any third-parties to which Your information is shared is allowed to use and/or further disclose User information. NOTWITHSTANDING ANYTHING CONTAINED WITHIN THIS PRIVACY POLICY, TACKL IS NOT RESPONSIBLE FOR ANY LOSS, MISUSE, UNAUTHORIZED ACCESS, DISCLOSURE, ALTERATION, OR DESTRUCTION OF YOUR PERSONAL INFORMATION BY ANY AD PARTNER, AFFILIATE, OR ANY THIRD PARTY WHO RECEIVES YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY. Below is a summary of some of the ways Tackl gathers information and the types of third parties with which such information may be shared. 4.2 Professionals on the Tackl Platform. If You request Tackl to find Professionals for You, Your Project information (including the contact information) that You provide will be made available to a limited number of Professionals that Tackl believes may be suitable for Your Project. Such Professionals are independent from Tackl and their use of Your data is not covered by this Privacy Policy. Professionals that participate on the Tackl Platform may view Your public activities on the Platform and receive feedback You provide to Tackl about Your engagement with them. For example, if You requested Tackl to find Professionals for You and provide Tackl feedback about Your level of interest in these Professionals, Tackl may convey such feedback to them. When You receive messages from Professionals through the Platform, Tackl and the Professionals can track Your interaction with these messages, including whether You opened the messages or documents shared with these messages. A Professional cannot see Your non-public account information or see private activity. 4.3 Analytics Services Providers; Vendors. Tackl compiles and provides aggregated statistics and insights to help understand how You are engaging with Content on and off the Platform. For example, Tackl works with analytics services providers to determine the number of Users or Professionals that have viewed or interacted with the Platform in any way, as well as aggregate demographic and other information to help understand User or Professional interactions with the Platform. Tackl provides information and Content to vendors and service providers that support Tackl’s business, such as by providing technical infrastructure services, analysis related to how Tackl’s products and services are used, and/or to provide support. 4.4 Advertisers and Ad Networks. Tackl uses advertising networks and Ad Partners to serve advertisements for Tackl and other businesses, including interest-based advertising, on third-party sites and to assist Tackl in evaluating the effectiveness of Tackl advertising. Tackl may also work with advertising networks and Ad Partners to serve ads on the Platform and to communicate with You at the addresses they have for You. Tackl may provide advertising networks, Ad Partners, and businesses advertising on the Platform with aggregate information but other than hashed information or device identifiers, Tackl does not disclose Your name, contact information, or other Personal Information. For example, Tackl may provide a hashed version of Your email address or other information to advertising networks (e.g., Facebook and Google) to serve advertisements to You or others. Depending on where You live, You may have the right to opt out of the sharing of Your information for this purpose. 4.5 Affiliates and Transfers. Tackl may share information from or about You with: (a) other companies affiliated with Tackl, or (b) a potential or actual acquirer, successor, or assignee as part of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Tackl’s business, assets, or stock (including bankruptcy or similar proceedings) to another company. Tackl may share Your Personal Information with that company and its advisors before and after the transaction date. In the event of a sale or transfer of Tackl, Tackl will notify You in the same way You are notified of a material change to this Privacy Policy. 4.6 Legal Obligations. Tackl may disclose information from or about You, as required or permitted by applicable Law, if Tackl believes that such disclosure is reasonably necessary to: (a) comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on Tackl, a service provider, or a partner (which may include disclosure to law enforcement, courts, or governmental authorities); (b) prevent, investigate, or identify possible wrongdoing in connection with the Platform; (c) protect Tackl’s rights, reputation, property, or that of Tackl visitors, users, corporate affiliates, or the public; or (d) enforce compliance with Tackl agreements with You (for example, the Tackl Terms and Conditions).
  5. Security. 5.1 Data Security and Retention. Tackl uses reasonable measures to protect Your Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of Your Personal Information. Tackl will keep Your Personal Information only for as long as necessary to fulfill the purposes for which Tackl is processing Your Personal Information unless the Law permits or requires Tackl to retain Your Personal Information for a longer period. For example, Tackl may need to keep Your Personal Information to provide services on the Platform or to defend future legal claims. Tackl also will retain de-identified information after Your Tackl Account has been deleted. Information You have shared with others will remain visible after Your Tackl Account has been deactivated, deleted, or after the information has been removed from Your own profile or Tackl Account. Please note that copies of information that You have updated, modified, or deleted may continue to reside in Tackl’s systems for a period of time, and Tackl may maintain copies of this information as part of its business records. 5.2 Security Safeguards. Tackl employs physical, electronic, and managerial measures to safeguard the information it collects online. However, it is impossible to fully eliminate security risks, so Tackl does not make any guarantees of any kind about the Platform or its related products or services. TACKL IS NOT RESPONSIBLE NOR LIABLE FOR ANY LOSS, MISUSE, UNAUTHORIZED ACCESS, DISCLOSURE, ALTERATION, OR DESTRUCTION OF YOUR PERSONAL INFORMATION. You are responsible for keeping Your username and password private. Once You have registered with Tackl, You will not be asked by Tackl for Your password. Tackl advises Users and Professionals to create unique passwords for their Tackl Account profiles and to not use this password for any other web services or applications and to not share this password with others. 5.3 Privacy of Minors. To access or use the Platform, You must be at least eighteen (18) years of age. If You become aware that someone under the age of eighteen (18) has provided Tackl with Personal Information without parental consent, please contact Tackl. If Tackl becomes aware that someone under the age of eighteen (18) has provided Tackl with Personal Information without parental consent, Tackl will remove such information and terminate any accounts associated with such person. 5.4 Data Controller. The information about You that Tackl collects, processes and/or uses through the Platform is hosted, controlled, and services are provided by Tackl and/or its affiliates as set forth in this Privacy Policy and Tackl’s Terms and Conditions.
  6. Cookie Policy and Ad Choices. 6.1 General. This Section 6 describes how Tackl uses Cookies and similar technologies. Tackl uses Cookies, web beacons, locally shared objects (sometimes called “flash cookies”), mobile identifiers, and similar technologies to help Tackl recognize You on the Platform, enhance Your experience, understand usage of the Platform, and show You relevant advertising. Cookies may also be set by other websites or services that run content on the page You are visiting. After You register on the Platform, Tackl may connect information it collects from the Cookies set by Tackl and its partners with other information received from You. The provision of data via Cookies is voluntary except for those Cookies that Tackl places on Your device because Tackl needs this information for the performance of the Platform and its services. 6.2 What Types of Cookies Tackl Uses. Tackl uses two types of Cookies on the Platform: “session cookies” and “persistent cookies.” Session Cookies are temporary Cookies that remain on Your devices until You leave the Platform. A persistent Cookie remains on Your device until You manually delete it. 6.3 Use of Cookies. Cookies transmit information about You and Your use of the Platform, such as Your browser type, search preferences, data relating to advertisements that have been displayed to You or that You have clicked on, and the date and time of Your use of the Platform. With the exception of identifier Cookies that are associated with Your registered Tackl Account to prevent fraud on the Platform, Cookies link to certain unique information (such as information on Your profile), but this is not linked to Your specific name. 6.4 Third Party Ad Partners. When Tackl works with its Ad Partners to present You with personalized advertising experiences, Tackl does not share information with Ad Partners that can be used to identify You or associate with You on an individual basis, unless You have instructed Tackl to do so (such as when You provide information requested by an Ad Partner). If a Tackl Ad Partner has information about You saved in one of the Ad Partner’s own Cookies, then the Ad Partner can use that information to help Tackl send You relevant ads, but the Ad Partners do not share information with Tackl that would lead to identifying individuals. 6.5 Consenting to Cookies and Opting Out of Cookies. Tackl uses Cookies that are necessary for Tackl to provide services to You, and You cannot opt out of these Cookies on the Platform. You are able to opt out of Cookies (other than the strictly necessary cookies) at any time. You may also disable placement of some (but not all) Cookies by setting Your browser to decline cookies, although this may diminish Your experience. Additionally, You are able to control, manage, and/or delete Cookies via Your browser settings. If You enable location data for any mobile version of the Platform, Tackl may use Your location data to provide geo-targeted ads from Ad Partners that are local to You. Tackl does not share Your location with Ad Partners. Geo-targeted ads occur because Tackl may provide Ad Partners with the ability to push ads to You in certain geographic areas. You can disable Your location services at any time in Your device privacy settings. 6.6 Ad Partner Cookies. When You visit Tackl from regions in which applicable Law requires Your consent for using non-strictly necessary Cookies, Tackl will surface a Cookie consent banner and request Your consent. If ads or other features on the Platform are provided by third-parties, these third-parties set and use their own Cookies, and these Cookies are subject to the third parties’ privacy notices and policies. Tackl has no access or control over these Cookies and Tackl takes no liability or responsibility for these Cookies in any way. Further, if You respond to ads posted by third-parties or submit information to third-parties via the Platform, such information is submitted to and governed by the third-parties and such third-parties’ respective privacy policies and notices, and Tackl shall have no responsibility or liability therefor.
  7. Privacy. 7.1 Your Privacy Rights. You may submit a data rights request to access, correct, delete, export, rectify, update, or ask questions about Your Personal Information. If You do so, Your name and email address will be requested. Tackl will then take measures to verify Your identity. You can object to processing Your Personal Information or ask Tackl to restrict processing Your Personal Information. You have the right to opt-out of marketing communications from Tackl at any time. Similarly, if Tackl has collected and processed Your Personal Information with Your consent, You are able to withdraw such consent. Withdrawing consent does not affect the lawfulness of any Personal Information processing that Tackl has conducted prior to Your withdrawing consent, and it will not affect processing Your Personal Information which may be lawful based on grounds other than Your consent. Tackl does not process Your information to make automated decisions about You which may have a legal or other significant effect. Tackl does not discriminate against Users or Professionals that exercise the privacy rights set forth in this Privacy Policy or otherwise available pursuant to applicable Law. Further, Tackl will respond in a reasonable time to requests from You wishing to exercise Your data protection rights provided by applicable Laws and/or as set forth in this Privacy Policy. Notwithstanding the foregoing, Tackl reserves the absolute right to keep any information in its archives that Tackl, in its sole but reasonable discretion, deems necessary to comply with Tackl’s legal obligations, resolve disputes, and enforce its agreements. 7.2 How Long Tackl Keeps Your Personal Information. Tackl keeps Your Personal Information as long as needed to operate the Platform and for the purposes set forth in this Privacy Policy. Retention periods can vary significantly based on the type of information and how the information is used. Tackl retention periods are based on criteria such as legally mandated retention periods, pending or potential litigation, Tackl’s intellectual property or ownership rights, contract requirements, operational directives or needs, and historical archiving. When Tackl no longer needs Your Personal Information and/or no longer needs to retain this information to comply with legal or regulatory obligations, resolve disputes and enforce Tackl’s agreements, Tackl will either remove it from its systems or depersonalize it so that the information does not identify specific Users or Professionals.
  8. Updates to Tackl’s Privacy Policy. Tackl may revise this Privacy Policy from time to time by posting an updated version on its website(s). The revised Privacy Policy will be effective immediately for all Users and Professionals. If Tackl makes a change that materially reduces Your rights or increases Your responsibilities, Tackl will notify You by posting a notice on its website(s) or the Platform prior to the change becoming effective. Tackl encourages You to periodically review this Privacy Policy for any updates. Your continued use of Tackl website(s) and/or Platform is subject to the most current effective version of this Privacy Policy. Any capitalized terms used in this Privacy Policy but not otherwise defined shall have the meaning set forth in Tackl’s Terms and Conditions. In the event of a conflict between this Privacy Policy and Tackl’s Terms and Conditions, then Tackl’s Terms and Conditions control. Tackl’s Terms and Conditions are hereby incorporated by reference into this Privacy Policy. If any term or provision of this Privacy Policy or the Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Privacy Policy or the Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.

Tackl will recognize Your opt-out preference, as opting-out of the sale or sharing of Your Personal Information with third parties as defined by applicable Law. Tackl will apply Your opt-out preference only to the browser or device used to signal Your preference. When You login to the Platform, Tackl will apply Your opt-out preference to Your Tackl Account. 9.3 Use of Personal Information. As provided in this Privacy Policy, use of the Tackl Platform by anyone under 18 years of age is strictly prohibited. Consequently, Tackl does not knowingly disclose information regarding individuals under 18 years of age to third parties in exchange for consideration. Tackl does not use or disclose sensitive Personal Information for purposes other than those set forth in the CCPA. In addition to the rights described above and in this Privacy Policy, California residents may also, subject to certain exceptions, request Tackl to provide information about how Tackl has used and shared Your Personal Information in the previous 12 months. Residents of California, Virginia, Colorado, and Connecticut also have the right to request correction of inaccurate Personal Information. Your authorized agent may exercise Your data protection rights on Your behalf by contacting Tackl. Tackl may still require You to directly verify Your identity and confirm that You have provided the authorized agent permission to submit the request. Please keep in mind that if Tackl does not receive adequate proof that You are authorized to act on the consumer's behalf, Tackl may deny the request. Whether You submit Your request directly or through an authorized agent, generally, the only means Tackl has to verify Your identity is for You to respond to a specific Tackl email from the email address associated with Your Tackl Account or to click a confirmation or similar button in a specific Tackl email from the email address associated with Your Tackl Account.
